We have an ex-HMRC Deputy Director to provide experienced professional tax advice
Tax Investigations included
We have experience and advise on all tax enquiries and liabilities.
Do you want to tell HMRC something?
Do you think you need to make a disclosure to HMRC either as a result of a “Nudge” letter you have received out of the blue or have you been worrying and need to clear up a tax matter? You have the opportunity to make a voluntary disclosure to HMRC and it gives you a chance to clear yourself of the worry.
Every case depends on its own facts and circumstances but approaching HMRC first can be very beneficial. As HMRC often say “It is better you come and talk to us rather than we come and talk to you!”.
We can help you frame a full and complete disclosure and our experience of HMRC governance processes can help your narrative to make the process as smooth as possible whist reducing the overall amount to pay in potential financial penalties.
Are you in an investigation and want to avoid legal costs in Court whilst settling the tax issue?
We can work with you to help settle matters. All cases are based on their own facts and circumstances but we know the various options that HMRC deploy to help reach a final outcome. This can be Court through a First Tier Tribunal but HMRC are always keen to explore all other ways before incurring those high costs. We can advise and represent you at an Alternative Dispute Resolution meeting and also less formal Without Prejudice discussions to try and resolve things at less cost to you.
FIS (Fraud Investigation Service) may ask for a meeting in connection with a Code of Practice 8 (COP8) enquiry. These enquiries are civil but arise where large tax losses are suspected and mainly through avoidance (not evasion).
FIS (Fraud Investigation Service) may ask for a meeting in connection with a Code of Practice 9 (COP9) enquiry. These are the most serious type of investigation. They are still civil and will have ruled out criminal prosecution at this stage. If the investigation is under COP9 this gives you the opportunity to come clean with HMRC and disclose all tax that you owe in your personal and business affairs in the last 20 years. This should be taken very seriously and advice is essential.
Protection from criminal prosecution only applies if you make a full and complete disclosure under the Contractual Disclosure Facility (CDF) and you admit tax fraud. And the clock is ticking with this, so it is essential that you take early action. If you act quickly this can reduce the amount of tax penalties to be paid. There is a direct benefit from taking early action and we can help.
Our experience will help you to navigate the process as efficiently as possible to help reduce your stress levels and have a clear sight for reaching a settlement.
